Years of credited service earned in the Metal Trade Branch Local 638 Pension Fund cannot be transferred to another Pension Fund. In addition, under the Plan in effect, pension monies are nontransferable. Therefore, before you leave covered employment we strongly suggest you contact the Pension Department to obtain your vesting status. Should you leave the industry before earning 5 years of credited service, your prior service will be cancelled after 5 consecutive one year breaks in service.
The Metal Trades Branch Local 638 Pension Fund is a defined benefit plan in which you are a participant. Accumulated contributions are employer contributions made on your behalf. Under the Plan in effect, pension monies are non-transferable and cannot be withdrawn. Because of this, your pension benefit cannot be used as collateral in securing a bank loan.

The Fund Office will need to review any decrees, agreements or orders relating to your marital situation to determine if they affect the payment of your benefits. A Qualified Domestic Relations Order ("QDRO") can require the Plan to pay part or all of your pension benefits to a former spouse or other dependent. Your pension benefits may be affected if a portion of your pension is allocated to a former spouse or dependant and you have failed to file a QDRO. Work performed in any trade not covered by the collective bargaining agreement or work that is not determined by the Trustees to be considered “Disqualifying Employment” would not preclude you from collecting a pension benefit and continuing your employment.
A participant who continues to work in the trade must abide by the following rules regarding collecting a pension benefit at the same time:

under the age of 65, may not work in "disqualifying employment" in a shop within the geographic area covered by the Plan and/or if the shop was of the same craft or industry as the Metal Trades and collect a pension benefit.
However, a participant/pensioner
over the age of 65, may not work in disqualifying employment in a shop within the geographic area covered by the Plan and/or if the shop was of the same craft or industry as the Metal Trades for
40 or more hours in
any month and collect a pension benefit.
At age 70 1/2, there is no restriction on the number of hours a participant or pensioner may work while receiving a pension benefit from the Pension Fund.
The Pension Fund will deduct federal taxes from a monthly pension benefit. You are required to complete at the time of retirement a W4P form. Each year you will receive a 1099R tax form from this office to use when filing taxes for the previous year.
Additionally, you may also withhold New York State, Local, and Yonkers Income tax by completing an IT-2104P. Taxes for states other than New York cannot be deducted.
